Section 8.01

Section 8.01 allows our neighborhood to completely remove the restrictive covenant from our deeds.  The exact wording is at the bottom of this page, but it requires the approval of 2/3 of homeowners.

We are maintaining a file of homeowners who have given standing approval for an execution of section 8.01.  If / when we reach the required number of homeowners, we can remove the covenant and the Coosawilla Homeowners Association will cease to exist.

Board Requirement

The board could refuse to execute the required instrument even with the required 2/3 vote of the homeowners,  so it's important to select board members willing to follow the will of the neighborhood.

Full Text of Section 8.01

This Declaration and the Restrictions contained herein shall run with and bind the· property for a period of twenty (20) yeas from and after the dale when this Declaration is filed for record with the Clerk of the Superior Court of Harrow County, Georgia, and which time this Declaration and Restrictions shall he automatically renewed for successive periods of ten (l0) years; provided, however that after the end of the said twenty (20) year period and during any ten (10) year renewal period (but only during such renewal period), this Declaration and the Restrictions contained herein may be terminated by an instrument executed by the proper Association officer, and recorded in the Office of the Clerk of the Superior Court of Barrow County, Georgia, or in any other such place of recording as may be appropriate at the time of the execution of such instrument, pursuant to a resolution approving such termination which is approved by a two thirds (2/3) vote of the Class A Members of the association.
